Agreement to these terms

These Terms and Conditions (“Terms”) are an agreement between you and Unmistakable LLC dba Inbox Welcome (“Inbox Welcome,” “we,” “us,” or “our”). They govern your access to and use of inboxwelcome.com and its content, forms, quizzes, scheduling links, and downloadable resources (the “Website”). They also apply to quizzes, request forms, and scheduling pages we link to and identify as Inbox Welcome offerings, while the third-party provider’s own terms may also apply.

By using the Website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Website. You must be able to form a binding contract in your jurisdiction to agree to these Terms. A parent or legal guardian must authorize use by anyone who cannot do so independently.

Changes to these terms

We may update these Terms as the Website or our practices change. Revised Terms apply prospectively when posted, unless a later date is stated. The effective date at the top identifies the current version. If a change is material, we may provide additional notice where appropriate.

The Website and its content

The Website provides marketing information, articles, educational material, contact and signup forms, quizzes, service-request forms such as nonprofit Power Up Hour requests, Advisory Hour scheduling links, and links to services offered by Inbox Welcome or third parties. It does not currently provide public user accounts, public comments, or a customer portal.

We may change, suspend, or discontinue any part of the Website. We do not promise that every page, resource, or feature will always be available, error-free, or current.

Acceptable use

You may use the Website only for lawful purposes. You may not interfere with its operation or security; attempt unauthorized access; introduce malware or harmful code; scrape, harvest, or send automated requests in a way that burdens the Website; impersonate another person; submit unlawful, abusive, infringing, deceptive, or confidential third-party material; use forms to send spam; or use the Website to violate another person’s rights.

When you submit information, you represent that you have the right to provide it and that it is reasonably accurate. We may restrict access or disregard submissions that violate these Terms or threaten the Website, our providers, or other people.

Intellectual property and downloads

The Website and its original text, graphics, branding, downloads, and other materials are owned by Inbox Welcome or used with permission and are protected by copyright, trademark, and other laws. No ownership rights transfer to you.

You may view the Website and use a resource we intentionally make available for download for your own personal or internal business purposes. Unless a resource states otherwise, you may not sell, sublicense, republish, distribute, remove attribution from, or create a competing product primarily from our content without written permission. Ordinary quotations and links permitted by law are not restricted by these Terms.

Information, not individualized advice

Website content is provided for general educational and informational purposes. Email deliverability and marketing results depend on facts, providers, policies, technical configurations, audiences, and other circumstances that can change. Website content is not a substitute for advice based on your specific situation.

No professional-client relationship

Reading the Website, downloading a resource, subscribing, completing a quiz, submitting a request form, or requesting an appointment does not by itself create a consulting, agency, fiduciary, or other professional-client relationship. Such a relationship begins only when you and Inbox Welcome enter into a separate written engagement or booking agreement.

Services, bookings, and payments

The Website may describe consulting services or link to a third-party booking or payment page. The scope, price, scheduling, cancellation, refund, confidentiality, and other terms for paid work are the terms presented at booking and any separate proposal, statement of work, or engagement agreement you accept. If those terms conflict with these Website Terms, the engagement-specific terms control for that paid work.

No guarantees and testimonials

We aim to provide useful and accurate information, but we do not guarantee any particular deliverability, revenue, reputation, engagement, or other outcome from using the Website or its resources. Examples and testimonials describe individual experiences and do not promise that you will obtain the same result.

Third-party links and services

The Website may link to or rely on third-party sites and services. We do not control their availability, content, security, or practices and are not responsible for them. A link does not necessarily mean that we endorse every statement, product, or practice of the third party. Your use of a third-party service is governed by its own terms and policies.

Information you submit

You keep ownership of information and materials you submit. You give us a limited right to receive, store, copy, and use them only as reasonably necessary to respond to you, provide a requested resource or service, operate the Website, and exercise our legal rights. Limitation of liability

To the fullest extent permitted by law, Inbox Welcome and its owners, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising from or related to the Website or its free resources.

To the fullest extent permitted by law, our total liability arising from or related to the Website or its free resources will not exceed the greater of the amount you paid specifically to access the Website during the 12 months before the claim or $100. This limitation does not govern paid services covered by a separate agreement and does not limit liability that cannot lawfully be limited.

California law and disputes

Informal resolution. Before filing a claim, you and Inbox Welcome agree to send the other a written description of the dispute and requested relief and to try in good faith to resolve it for 30 days. Notices to Inbox Welcome may be sent to the email or postal address below.

California law governs these Terms, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Website may be brought in the state or federal courts located in Sacramento County, California, and you and Inbox Welcome consent to jurisdiction and venue there, except where applicable law requires another forum.

Miscellaneous

These Terms and the Privacy Policy are the entire agreement concerning use of the Website, except for separate terms that apply to a specific resource, booking, or engagement. If any provision is unenforceable, it will be modified only as much as necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, financing, or sale of the business. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
